Service Level Agreement
PLEASE ENSURE THAT YOU READ AND UNDERSTAND THIS SERVICE LEVEL AGREEMENT BEFORE YOU USE PYNGTRIP APPLICATIONS. If you continue to browse and use our website, WhatsApp booking, phone lines and driver dispatch systems, you are agreeing to comply with and be bound by the following Service Level Agreement that governs the relationship between PyngTrip, V Advertisements, Building No. 2124, Loharwin, Hamirpur, Himachal Pradesh – 177001, India (GSTIN 02DRAPB0269L1Z6), hereinafter referred to as “PyngTrip”, and you, hereinafter referred to as “Vendor/Driver”.
2. The Parties Hereto Agree as Follows
2.1 PyngTrip provides services for the purpose of providing lead generation to transportation service providers. PyngTrip receives requests from the users of PyngTrip’s various channels such as the website, WhatsApp, phone calls and other means. PyngTrip transfers these requests to the authorized transportation provider / “Vendor/Driver”. The “Vendor/Driver” seek, receive and fulfil the requests provided to them from PyngTrip.
2.2 The “Vendor/Driver” acknowledges and agrees that PyngTrip is only a technology platform to provide various transportation or logistics services through its Vendors who are independent third party contractors not employed by PyngTrip and that PyngTrip does not itself provide transportation services or function as a transportation carrier or operate as an agent for the transportation of passengers.
3. Mutual Agreement
PyngTrip and the “Vendor/Driver” mutually agree to be bound by the following terms and conditions set forth (electronic or otherwise) in this Agreement.
4. Definitions
4.1 “Driver” means a principal, agent, employee or contractor of the Vendor who: (a) fulfils the then-current PyngTrip requirements to be an active driver using the PyngTrip services; (b) is authorized by PyngTrip to access the PyngTrip services to provide transportation services on behalf of the Vendor or on own account, as the case may be; and (c) is verified by the Vendor and whose names are forwarded to PyngTrip by the Vendors for passing off the leads to them directly.
4.2 “Users” means a customer end user, not being a minor (under the age of 18 years), of the various channels of PyngTrip like the website, WhatsApp booking and call centre numbers, for the purpose of obtaining transport services offered by PyngTrip’s transportation “Vendor/Driver”.
4.3 “Vehicle” means any vehicle owned, leased or hired by the Vendor that fulfils current PyngTrip requirements for a vehicle on the platform.
5. Vendor/Driver Relationship with Users
5.1 Vendor acknowledges and agrees that Vendor’s provision of transportation services to Users creates a legal and direct business relationship between Vendor and the User, to which PyngTrip is not a party. PyngTrip is not responsible or liable for the actions or inactions of User in relation to the activities of Vendor, its Driver or of any Vehicle.
5.2 Vendor/Driver is free to take any action against the User in case any dispute including but not limited to misbehaviour, destroying or damaging the vehicle or non-payment of the agreed amount arises.
6. Vendor’s Relationship with PyngTrip
6.1 Vendor acknowledges and agrees that PyngTrip’s provision to Vendor of the various channels creates a legal and direct business relationship between PyngTrip and Vendor as an independent contractor.
7. Vendor’s Relationship With Drivers
7.1 Vendors shall have the sole responsibility for any obligation or liability to Drivers that arise from its relationship with its Drivers.
7.2 A Vendor acknowledges and agrees that after receiving transportation services, a User will be prompted to provide ratings and feedback in good faith.
8. Drivers and Vehicles Requirements
8.1 Driver Requirements: Hold and maintain valid commercial driver licence, third party insurance, pollution certificates; maintain neat, sanitized vehicles; strict prohibition of smoking, alcohol and narcotic consumption.
8.2 Vehicle Requirements: Properly registered, licensed passenger transportation vehicle in good operating condition and safety compliance.
8.3 Documentation: Vendors must submit copies of all valid vehicle documentation, permits, and tax compliance certificates prior to receiving leads.
9. Payment Policy and Fare Adjustment
9.1 Pricing and fare structures are communicated upfront per lead. Penalties may apply for unexcused cancellations or delays.
9.2 Vendors maintain a minimum account balance for lead allocation.
10. Intellectual Property
The PyngTrip services, logo, website, dispatch system and brand marks remain the exclusive property of PyngTrip / V Advertisements.
11. Jurisdiction & Disputes
Disputes shall first be attempted to be resolved amicably through good-faith negotiation. Any unresolved matters are subject to binding arbitration seated at Hamirpur, Himachal Pradesh, India.
